Acceptance of Terms
whatscooking.com.au (“whatscooking”)
provides an on-line advertising service to businesses
and community services in their local area that
is subject to the following Terms Of Use (“TOU”).
Updates
to the TOU
The TOU may occasionally be updated or modified.
Advertisers can review the most current version
of the TOU by clicking on the link “Terms
Of Use” located at the bottom of the whatscooking
web pages.
Description
of Services
The whatscooking web-site is an on-line Directory/Guide
to businesses and community services in the Toronto,
Maitland, Hunter Valley District. The whatscooking
Directory aims to provide businesses with an opportunity
to display all aspects or their business!
Advertising
Advertisers agree that their business will be listed
with the whatscooking business and community Directory/Guide
for a period of 24 months and may be renewed thereafter
on payment of the then current Advertising Fee.
Advertising
Prices
Fees for services provided by whatscooking are set
out in the whatscooking “Advertising Packages”
page and may be amended from time to time. Advertisers
can review current prices by clicking on the link
"advertising_packages"
located at the bottom of the whatscooking web pages.
Advertising,
links to third party web sites
The whatscooking web-site contains hyperlinks to
Internet web sites operated by third parties. Third
party web sites are not under the control of whatscooking
and whatscooking is not responsible for the content
of any linked web sites or any hyperlink contained
in a linked web site. The inclusion of any link
does not imply any endorsement of the linked web
site by whatscooking.
Whatscooking takes no responsibility for embedded
hyperlinks or referral buttons that link to third
party web sites and whatscooking visitors link to
these web-sites entirely at their own risk.
Third party advertisers
are solely responsible to you for the delivery of
any goods or services you purchase on a third party
web site. Offers made by third party web-sites are
which you can accept by linking to and executing
the relevant transaction. Such offers are not made
or indorsed by whatscooking.
Termination
by Advertisers
Advertisers may, at any time, terminate all advertising
with whatscooking, and in such event, it will not
be entitled to a refund of any portion of the advertising
fee paid on commencement / renewal of such advertising.
Accuracy
of Content
Advertisers agree that :-
> they are responsible for viewing their web-display
and advising of any corrections or changes that
are necessary to keep the content of the site accurate
and current.
Payment
Advertisers agree to ensure that all fees / other
monies due to whatscooking are paid promptly. In
the event of advertisers failing to pay any such
fees / other monies on time, whatscooking will be
entitled to give advertisers written notice to make
payment within 2 weeks, failing which all advertising
may be terminated.
Some businesses have been offered free advertising
to help construct our web-site with a wide range
of quality content. Our aim is to build a creditable
reputation for satisfied customers, one that will
encourage more Internet users to visit our web-site!
No
Unlawful Use.
By using the whatscooking services advertisers agree
not to :-
> violate any Australian law or regulation, including
any Copyright or Intellectual Property rights of
others.
> make available content or material that is
dishonest, false or deceptive.
Prohibited
Use
The whatscooking web-site may, at
it's sole discretion, deny some advertisers access
to promote services that are considered unsuitable,
distasteful, or unpleasant.
Ownership
of Content
The whatscooking web site does not claim
ownership of materials posted by advertisers, however
by submitting material advertisers grant whatscooking
permission to publish, distribute, transmit, reproduce,
copy, edit and publicly display submissions in connection
with the promotion of services provided by whatscooking.
By posting, uploading, or displaying information
and /or images, advertisers warrant that they own
such content ("content") or have required
permission to use such content. Advertisers acknowledge
that the content can be down-loaded by users for
personal use only, strictly on the condition that
the it is kept intact and in the same form as presented
on the whatscooking web site.
Disclaimer
of Liability
The whatscooking web site accepts no responsibility
or liability for information or content placed on
it's web site, and advertisers are responsible for
the accuracy or legitimacy of their viewing material.
The whatscooking web site reserves the right to
remove any content or material if advertisers do
not comply with the whatscooking TOU. Whatscooking
will not be held liable for any damages of any kind
arising from the use of this web-site, including,
but not limited to direct, indirect, incidental,
punitive, and consequential damages to the full
extent applicable by the laws of NSW Australia.
